Approve the Temporary Use Agreement with Southern Underground Industries, Inc. for the use of CRA-owned properties located at 19 SW 10th Avenue and 23 SW 10th Avenue for a City of Delray Beach Reclaim Water Improvements Project.

Body
Background:
Southern Underground Inc. (Southern) is working with the City of Delray Beach (City) on the City’s Area 5, 10, and 14 Reclaim Water Improvements Project. Southern has requested to utilize two (2) CRA-owned properties located at 19 SW 10th Avenue, Delray Beach, Florida, 33444, and 23 SW 10th Avenue, Delray Beach, Florida, 33444 (Premises) as a storage and staging area for construction equipment needed to complete the Project. The Premises are needed for a term between October 30, 2025, through April 30, 2026. Southern will install a fence with a mesh barrier along the perimeter of the Premises to prevent use by the general public. The Premises will be restored by Southern Underground Inc. upon the completion of the term.
At this time, CRA Staff is requesting the CRA Board approve the Temporary Use Agreement with Southern Underground Industries, Inc. to use CRA-owned properties located at 19 SW 10th Avenue and 23 SW 10th Avenue as a staging and storage area for construction equipment for the City of Delray Beach Area 5, 10, and 14 Reclaim Water Improvements Project.

CRA Attorney Review:
The CRA Legal Counsel has prepared and reviewed the Temporary Use Agreement for legal sufficiency and form and determined it to be acceptable.
