Motion to Approve a Hold Harmless Agreement to allow the encroachment into the public right-of-way at 403 SE 1st Street.

Background:
The property is located on the northeast corner of SE 1st Street and SE 4th Avenue in the Central Business District (CBD). The encroachment is associated with a Site Plan Modification that involves the installation of a new awning along the west elevation. At its meeting of March 9, 2016, the Site Plan Review and Appearance Board (SPRAB) approved the architectural elevations by a vote of 5-0 (Jose Aguila and Roger Cope absent), which included the encroachment of the awning into the public right-of-way, subject to the approval of a Hold Harmless Agreement.
