RESOLUTION NO. 148-22: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DELRAY BEACH, FLORIDA, APPROVING A MAINTENANCE MEMORANDUM OF AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION FOR THE INSTALLATION AND MAINTENANCE OF PEDESTRIAN LIGHTING IN FLORIDA DEPARTMENT OF TRANSPORTATION RIGHT-OF-WAY; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AMENDMENTS AND TAKE ALL ACTIONS NECESSARY TO EFFECTUATE THIS AGREEMENT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.

Body

Recommended Action:

Recommendation

Motion to review and consider Resolution No. 148-22 approving a Maintenance Memorandum of Agreement (MMOA) with the Florida Department of Transportation (FDOT) for the installation and maintenance of pedestrian lighting.

Body

Background:

The MMOA is associated with the Atlantic Crossing project that is located at the northeast corner of Atlantic Avenue and NE 6th Avenue.  The development is required to install pedestrian lighting in the right-of-way along Atlantic Avenue, which is a FDOT right-of-way.  Consequently, the FDOT seeks an agreement with the City for the maintenance.  A separate agreement to transfer this maintenance agreement to the Edwards Company will be provided at a later date and approved administratively.
