Background:

 

The subject property was previously occupied by U-Haul, Hertz Rental Car and an automotive sales and repair facility. The site currently contains an existing 5,310 sq. ft. one-story building built in 1972. It consists of 1.273 acres on lots 19 through 27 of the Osceola Park Subdivision. 

 

On October 28, 2015, the Site Plan Review and Appearance Board (SPRAB) conditionally approved a Class V Site Plan proposal to demolish the existing site and construct a retail shopping center with associated parking and landscaping.

 

The SPRAB approval requires a 4’ right-of-way dedication along the rear alley. Pursuant to LDR Section 5.3.1(D)(2), the required width of an alley is 20’.  Further, pursuant to LDR Section 5.3.1(D)(3), additional right-of-way width may be required to promote public safety and to ensure adequate access, circulation and parking in high intensity use areas. The existing alley right-of-way width is 16’. The applicant is providing an additional four feet in the form of a right-of-way dedication along the east side of the alleyway. The 4’ r-o-w dedication must be executed by deed agreement between the City of Delray Beach and the land owner, which is attached to this memorandum.

Timing of Request:

This is a Condition of approval for the site plan.
