Motion to Approve Resolution 49-26 amending Resolution 79-18 providing settlement authority limits for all claims and litigation involving the City; removing authority to settle claims and litigation from the risk management division.

Background:
On July 10, 2018, the City Commission of the City of Delray Beach (“City”) passed and adopted Resolution No. 79-18 which established settlement authority limits for all property damage, bodily injury and other claims and litigation of which the City is a party to. Currently, the settlement authority of the City Manager for all property damage, bodily injury, and other claims and litigation is $65,000, $25,000 for the City Attorney and $15,000 for the Risk Management Division.
Staff recommends that settlement authority for all claims and litigation for which the City is a party be limited only to the City Attorney in the amount of $25,000 and $65,000 for the City Manager; and

Approved as to form and legal sufficiency.
