Motion to Approve Resolution No. 25-16 conveying the northern 15 feet of the lot located at 606 SE 4th Street in exchange for an exclusive easement over same.

Background:
Delray Cottages is seeking clear title to a 15-foot portion of property on the northern edge of the lot located at 606 SE 4th Street. This portion of the lot was deeded to the City in 1963 by special warranty deed for the purposes of installing and maintaining a public roadway and utilities. The City has no record of requesting or accepting the deed. In order to clear title, Delray Cottages has requested that the City quit claim this portion of the property in exchange for an exclusive easement over the same area. The easement shall be used for installing and maintaining City-owned utilities. At this time, the City has no plans to widen the right-of-way on that section of SE 4th Street.
