SAMAR MIXED-USE DEVELOPMENT HOLD HARMLESS AGREEMENT FOR WORK PERFORMED WITHIN THE STATE RIGHT-OF-WAY
Body
Recommended Action:
Recommendation
Motion to consider acceptance of a Hold Harmless Agreement for work in Florida Department Of Transportation's (FDOT) right-of-way.
Body
Background:
Consider acceptance of a Hold Harmless Agreement for work in FDOT right-of-way.
The Samar Mixed-Use Development project is located on the west side of SE 5th Avenue (south bound Federal Highway) between SE 2nd and SE 3rd Street. It is bordered by the Central Business District on the north, east and south boundaries, and by Multiple Family Residential on the west. The total project area is 1.7889 acres and will consist of 35 condominium units; 6,280 sq. ft. of retail space; and 122-room hotel with a restaurant / lounge. The project will also include the construction of a proposed storm water management system, utility infrastructure, pavement markings, and signage. The utility infrastructure will require work to be performed within the FDOT right-of-way, including connections to existing water and sanitary sewer mains and any pavement restoration associated with this work. In order to apply for a State of Florida utility permit the City is required to sign the application on behalf of the Developer to allow the installation/construction to take place in the State right-of-way.
The proposed Hold Harmless Agreement shall provide that the Developer shall hold harmless and defend the City and the State for the work performed in the aforementioned right-of-way.
After the execution of this agreement is finalized, the City will sign the permit application for the work within the right-of-way.
