Consider acceptance of a General Utility Easement Agreement between the owner of 12 NE 5th Avenue and the City of Delray Beach.

 

Body

Background:

On July 24, 2024, the Site Plan and Appearance Board (SPRAB) voted to approve the Level 2 Site Plan application for the construction of one-story 4,420 square foot restaurant with 580 square feet mezzanine for the property located at 12 NE 5th Avenue. The site plan has been reviewed by Engineering, and it has been determined that a 10-foot general utility easement is required along the west side of the property line.

 

City Attorney Review:

The General Utility Easement Agreement has been reviewed as to form and legal sufficiency.

Timing of Request:

The General Utility Easement Agreement shall be recorded prior to building permit issuance.
