Background:

In the Intracoastal Waterway between Atlantic Avenue and George Bush Boulevard, community reports, confirmed by City staff observations, indicate conditions exist such that there is risk of vessel collision which endangers life, limb, and marine property, per 327.33 Florida Statutes. These conditions were observed in the waterway, even when some vessels operated at the posted speed limit, although many vessels were operating in excess of the posted speed limit. Conditions observed include unsafe levels of vessel traffic congestion, excessive speeding, and vessels changing course and slackening speed to avoid risk of collision.

Resolution 95-21 urges the Florida Fish and Wildlife Conservation Commission to consider the concerns of residents and establish a "Slow Speed - Minimum Wake" Zone within the Intracoastal Waterway system between Atlantic Avenue and George Bush Boulevard. This resolution is a necessary component of a request to the Florida Fish and Wildlife Conservation Commission, per 68D-24.003(4)(a) Florida Administrative Code.
