Background:
Item A1

Consider acceptance of an Agreement for Water Service for property located outside the municipal boundaries of the City of Delray Beach (City); located outside the municipal boundaries of the City of Delray Beach (City); located at 4535 Barrett Street. The owner submitted a water sewer application number #2021-160, for water service (domestic potable water) located at Lot 25, Block 2, Kingsland Pines, according to the map or plat thereof, as recorded in Plat Book 25, Page 2, Public Records of Palm Beach County, Florida owned by Kathryn A. Lozowski. Any furnished water under this Agreement shall not be used for irrigation purposes unless such use is specifically and separately approved by the City Manager or designee.

In consideration for the privilege of receiving water service from the City, the owner Kathryn A. Lozowski, agrees that the execution is considered a voluntary petition for annexation pursuant to section 171.044, Florida Statutes, or any successor or amendment thereto.

The property shall be subject to annexation at the option of the City at any time it is eligible under any one or more of the laws concerning annexation and referenced in the agreement.

City Attorney Review:
Approved to form and legal sufficiency.
