Motion to approve a Memorandum of Understanding (MOU) with the Solid Waste Authority of Palm Beach County (SWA) and the City of Delray Beach in accordance with Section 403.7071, Florida Statutes.

 

Body

Background:

During the 2024 legislative session, the Florida Legislature amended Section 403.7071, Florida Statutes, effective June 26, 2025, to strengthen statewide preparedness for storm-generated debris following major storm events. The revised statute now requires every county and municipality to secure authorization from the Florida Department of Environmental Protection (FDEP) for at least one Disaster Debris Management Site (DDMS) and to annually seek pre-authorization for any previously approved sites.

To comply with the amended statutory requirements and FDEP’s guidance, the City must enter into the attached MOU in order to jointly apply for DDMS authorization. The terms and conditions of the use of such sites, upon authorization, are outlined in the Interlocal Agreement previously executed by the Parties for this purpose and dated July 27, 2007.
