Acceptance of a Landscape Maintenance Agreement (LMA) for the property located at 319 NE 3rd Avenue.

Background:
On July 16, 2024, the City Commission voted to uphold through the appealable process an administrative approval of a Level 2 Site Plan modification for the construction of second-story addition and a change of use to establish a restaurant at the property addressed as 319 NE 3rd Avenue. The project proposes landscaping within the public right-of-way along NE 3rd Avenue. Pursuant to requirements of the Land Development Regulations, the property owner is responsible for perpetual maintenance of landscaping located in the right-of-way, which is stipulated in the LMA.
