Approve Resolution No. 2026-08 and the Quit Claim Deed for the transfer of the parking lot located at 215 SE 2nd Avenue, in substantially the attached form, and authorize the CRA Board Chair to execute the Quit Claim Deed, and any related documents, in a form acceptable to the CRA Legal Counsel.

Background:
The subject property, a parking lot located at 215 SE 2nd Avenue, was acquired by the Delray Beach Community Redevelopment Agency (CRA) in 2012. Since acquiring the subject property in 2012, the CRA has improved and maintained it. The intent of the subject property’s transfer to the City of Delray Beach (City) is for the City to maintain the property in perpetuity. Pursuant to Florida State Statutes, Section 163.3755, all community redevelopment agencies are required to sunset on the earlier of the termination date stated in their charter, or September 30, 2039, unless the governing body of the community redevelopment agency approves its continued existence by a majority vote. Currently, Delray Beach CRA’s sunset date is September 16, 2044. The Delray CRA would be unable to maintain the subject property after its sunset date. The City has agreed to accept ownership of the property and maintain it in perpetuity.

At this time, CRA Staff is recommending that the CRA Board approve Resolution 2026-08 and the Quit Claim Deed for transfer of the parking lot located at 215 SE 2nd Avenue, in substantially the attached form, and authorize the CRA Board Chair to execute the Quit Claim Deed, and any related documents, in a form acceptable to the CRA Legal Counsel.
