Recommendation

Acceptance of a Landscape Maintenance Agreement (LMA) for the property located at 201 SE 4th Avenue (FKA Unit 3 at 408 SE 2nd Street).

Body

Background:

On September 28, 2022, the Site Plan Review and Appearance Board (SPRAB) voted to approve a Class V Site Plan, Landscape plan, and Architectural Elevations for the construction of a 3-unit townhome development located at 408 SE 2nd Street; the address of the property has been updated for the new project. The approved development included landscaping within the public right-of-way along SE 4th Avenue and SE 2nd Street. Pursuant to requirements of the Land Development Regulations (LDR), the property owner is responsible for perpetual maintenance of landscaping located in the right-of-way, which is stipulated in each LMA.

Approved as to form and legal sufficiency.

Recordation of each LMA is required prior to issuance of a building permit for the approved project.
