Background:

Consider Acceptance of a Right of Way Deed for 2’ of alleyway at 102 NE 1^st Ave.

On June29^th, 2015, Old School Office Suites LLC.(Owner) along with Green Team Enterprises Inc. submitted a building permit application (permit #15-158339) to construct an addition on a commercial building located at 102 NE 1^st Ave.

The property is located east of N. Swinton Ave. at the intersections of NW 1^st St. and NE 1^st Ave. The current alley right of way width north of NE 1^st St. is 16’. Per LDR Section 5.3.1(D)(2), the required minimum width of an alley is twenty feet (20’). As a result, a 4-foot alley dedication is required with 2-feet from 102 NE 1^st Ave. and the other 2-feet being obtained on the west side of the alleyway when that property makes application for proposed improvements that would warrant an alleyway right-of-way dedication request.
