Background:

 

Consider Acceptance of a Right of Way Deed for 2’ of alleyway at 102 NE 1st Ave.

 

On June29th, 2015, Old School Office Suites LLC.(Owner) along with Green Team Enterprises Inc. submitted a building permit application (permit #15-158339) to construct an addition on a commercial building located at 102 NE 1st Ave.

The property is located east of N. Swinton Ave. at the intersections of NW 1st St. and NE 1st Ave. The current alley right of way width north of NE 1st St. is 16’. Per LDR Section 5.3.1(D)(2), the required minimum width of an alley is twenty feet (20’). As a result, a 4-foot alley dedication is required with 2-feet from 102 NE 1st Ave. and the other 2-feet being obtained on the west side of the alleyway when that property makes application for proposed improvements that would warrant an alleyway right-of-way dedication request.
