ACCEPTANCE OF WATER EASEMENT DEED FOR THE PROPERTY LOCATED AT 526 NORTH OCEAN BOULEVARD

Body

Recommended Action:

Recommendation

Motion to Approve acceptance of a Water Easement Deed for the property located at 526 North Ocean Boulevard.

Body

Background:

The owner (Randy Broda of KHB Delray LLC.) is planning to abandon 2 easements and has proposed a new 12’ water easement for an 8” water main relocation at 526 N. Ocean Blvd. The developer (Seaside Builders) will perform the proposed 8” water main relocation and has estimated the proposed construction completion within 30-60 days after commencement. The easement abandonments will take place after the proposed 8” water main is constructed and approved by all agencies.

A water main relocation plan is enclosed which depicts:

1)                     An abandonment of a 12’ easement for a previous removed 2” water main adjacent to the north property line. Labeled as “exhibit A” on the water main relocation plan.

2)                     An abandonment of a 6’ ingress and egress easement straddling the lot 1 and 2 property line. Labeled as “exhibit B” on the water main relocation plan.

3)                     The proposed 12’ water easement with the proposed 8” water main to be constructed. Labeled as “exhibit C” on the water main relocation plan.

A Hold Harmless Agreement has been submitted for city commission approval as part of this project.
