Motion to approve the Interlocal Agreement between the City of Delray Beach and Palm Beach County which allows the City to utilize the Homeless Resource Center ("HRC") to assist our homeless population.

Background:

This Interlocal Agreement between the City of Delray Beach and Palm Beach County allows the City to utilize the Homeless Resource Center ("HRC") to assist our homeless population.  The HRC is not a temporary lodging facility but a facility that will endeavor to end homelessness for qualified individuals that voluntarily commit to participate in the services and programs offered by the HRC.

As part of the Agreement, the Delray Beach Police Department agrees to participate in the Best Practices that Palm Beach County developed by Palm Beach County Law Enforcement when dealing with homeless individuals.  These Best Practices are attached to this Agreement as Exhibit A.  As part of the Best Practices procedures when a Law Enforcement Officer encounters a homeless individual, the officer will fill out a Field Referral Form attached to this Agreement as Exhibit B.

If a qualified individual wishes to end his/her homelessness, the City will agree to physically transport the individual to the homeless shelter either by direct transport or by utilizing the County's contracted transport provider paying the actual cost of the transport to the County which will be invoiced to the City twice a year.  The cost per transport is $3.14 per mile.  It is unknown at this time how many homeless people will utilize the service. 

Should a homeless person decide not to end their homelessness, the individual will be transported back to the original location from which he/she originated if a transport service is utilized.  The City will still be required to reimburse the County for the cost of the partial trip.  If the City chooses to transport the individual themslves, the individual may be transported back to a mutually acceptable location within the City.

The term of the Agreement is for five years upon execution of this Agreement. There may be three successive periods of five years each under the same terms and conditions of the Agreement.  Either party may terminate this Agreement with or without cause after receipt of sixty days written notice.
