Motion to Rescind approval of the land sale contract for the subject parcel.

Background:
On January 24, 2017, the City Commission approved the sale of a formerly abandoned alleyway (hereinafter referred to as the “property”) located on NW 9th Avenue for $9,500.00. The property is a portion of a parking lot located between the Corcoran Group plaza and the Patio Delray. After reviewing the property’s location and the boundary lines of same, it does not appear to be in the City’s best interest to sell this property to a third party.
Subsequent to the Commission’s approval, it was determined that the subject property abuts two parcels that are owned by the same property owner, Palm Trail Plaza Inc. By selling the subject property to a third party, the City would not only create a non-conforming lot but may be creating an avoidable conflict between Palm Trail Plaza Inc. and the proposed third party owner of the subject parcel.

The Sale of Land Contract has not yet been executed.
