Motion to retroactively approve an extension of the License Agreement with Delray Intracoastal Cruises, LLC (Pilgrim Belle Cruises, LLC) for a period of one year.

 

Body

Background:

On October 3, 2003 the City entered into a License Agreement with Delray Intracoastal Cruises, LLC for lease of the City dock. Amendment No. 3 to the License Agreement dated September 11, 2013, extended the Agreement through February 1, 2017. An ninety day extension to the License Agreement was approved by the City Manager on December 30, 2016 extending the term of the Agreement through May 1, 2017. Delray Intracoastal Cruises, LLC wishes to continue utilizing the City dock under the Agreement terms and conditions.

 

Due to the construction of the seawall at Veterans Park, which may impact operations of a boat cruise, staff recommends retroactively extending this Agreement for a period of one year from May 2, 2017 through May 1, 2018. This will allow adequate time for construction completion and to issue a formal request for proposals for a new License Agreement for use of the dock.

 

This motion is in accordance with the City Code of Ordinances, Section 36 and City Policies and Procedures, Change Orders and Amendments; Contracts must be amended in the same manner in which they were executed.

Finance recommends approval.

 

Funding Source:

This is a revenue generating contract for the City of Delray Beach.
