Motion to Approve Resolution No. 54-17 formally abandoning the City’s interest in the 40’ wide by 647.48’ long reserved right-of-way, adjacent to Delray Square at 14530 South Military Trail.

 

Body

Background:

The property owner of Delray Square at 14530 South Military Trail is seeking the abandonment of a 40’ right-of-way adjacent to the property through Palm Beach County (County). As part of the County’s abandonment process, the County is requiring the City of Delray Beach to formally abandon its interest in the right-of-way. This 40’ wide portion of South Military Trail was deeded to Palm Beach County in 1986 by Delray Square Shopping Center Associates as a State of Florida Right-of-Way Reservation. The existing right-of-way measures 120’ wide, which meets the Ultimate right-of-way requirement listed in Table T-1 of the Transportation Element; the “reserved” 40’ right-of-way is in addition to the 120’. Additionally, the 40’ portion, which measures 647.48’ long, currently contains landscaping and parking improvements associated with and maintained by Delray Square.

 

The subject request is associated with a Master Development Plan Modification for Delray Square for the addition of a restaurant within the existing parking area and adjacent to the shopping center’s access road from South Military Trail.
