Motion to Approve a Utility Work by Highway Contractor Agreement with the Florida Department of Transportation for performing construction services relocating water utilities relating to the Florida Department of Transportation's (FDOT) I-95 at State Road 806 / Atlantic Avenue Interchange enhancements project, FDOT Financial Project ID No. 434722-1-56-02 (City Project No. 2014-075).

Background:
The proposed roadway enhancements for the I-95 and Atlantic Avenue intersection are in the final design phase by FDOT, which includes the addition of turn lanes and re-alignments of on/off ramps. The project limits along Atlantic Avenue corridor extend from the E-4 Canal (east side of Atlantic Community High School) to NW 10th Avenue.
To accommodate the enhancements, water mains that are currently in FDOT’s Right-of-Way within the footprint of the proposed improvements will need to be relocated and/or adjusted. At approximately two dozen areas along the corridor, existing water mains have been identified to conflict with the proposed improvements. The City’s consultant, Kimley Horn Associates, will be submitting final utility relocation plans and specifications to the FDOT’s design consultant for incorporation into FDOT’s highway construction documents, to be bid and constructed with the roadway enhancements.
The attached “Utility Work by Highway Contractor Agreement” between the FDOT and the City of Delray Beach will allow the FDOT to have their contractor perform the utility relocations during the construction of the highway enhancements, at the FDOT’s expense.

Finance recommends approval.
Funding Source:
Funding in the estimated amount of $550,000 is proposed in the CIP budget for 17/18. The funding for this item is contingent upon Commission approval of the budget and will be available from account number 442-5178-536.63-90 (Water/Sewer Renewal and Replacement Fund: Other Improvements).
Timing of Request:
This request is time-sensitive in maintaining FDOT's project schedule, as well as ensuring FDOT's committment to fund and perform the utility relocations at their expense.
