Motion to terminate the Agreement for data center colocation and fiber transport services with GoRack, LLC, in Jacksonville, Florida, effective November 5, 2017.

Background:
On January 5, 2016, the City of Delray Beach (“City”) City Commission approved the award of an Agreement with GoRack, LLC, effective through February 18, 2021, for data center colocation and fiber transport services for a secondary data storage site. Although the City had begun to implement the secondary storage site, it was later determined that the Jacksonville location was not a preferred data storage site. As a result, City staff investigated other sites and determined that Tallahassee presented a more secure location. Florida State University has a facility located in Tallahassee that will meet the City’s secondary data storage site requirements. The FSU facility will cost approximately $40,000/year less per year than the GoRack facility in Jacksonville. However, prior to entering into a new agreement with FSU, the City’s agreement with GoRack must be terminated.

Article 7 of the Agreement with GoRack allows the City Commission to terminate the Agreement for convenience by providing no less than thirty days written notice. Attached is a copy of the proposed termination letter. Under the terms of the Agreement, the company will be paid for all services properly performed under the Agreement through the termination date.
