Move to approve Resolution No. 01-18 for the abandonment of a portion of the road right-of-way for NW 1st Street, east of the E-4 Canal, by adopting the findings of fact and law contained in the staff report, and finding that the request and approval thereof is consistent with the Comprehensive Plan and meets criteria set forth in Section 2.4.6(M)(5) of the Land Development Regulations, and further providing for approval of the execution by the Mayor of a quit claim deed to convey to Palm Beach County portions of abandoned right-of-way owned by the City of Delray Beach.

 

Body

Background:

This portion of the NW 1st Street was created from the original Model Land Company plat of the area. The area to be abandoned is 50.95 feet wide by approximately 180 feet deep.

 

With acquisition of the property on the south side of the area to be abandoned, the request is to combine the subject area with the properties to the north and south. The remaining ROW will "dead-end" into the Palm Beach County property and will provide access only to the Palm Tran South County Facility. The right-of-way contains existing utilities and is paved.  Replacement easements for the utilities within the area to be abandoned will need to be provided by Palm Beach County at their expense.  It is noted that the development plans identify these easements.
