Recommended Action:

Recommendation

Motion to approve Amendment No. 2 to the Agreement with Dev-Land Demolition & Site, Inc. for lime sludge removal and disposal in an annual amount not-to-exceed $210,000 through April 14, 2019.

Body

Background:

On April 15, 2015, the City of Delray Beach (City) issued an agreement with Dev-Land Demolition & Site, Inc. (Dev-Land) for lime sludge removal and disposal (Agreement) in accordance with ITB No. 2015-32. The Agreement was effective through April 14, 2017 and includes two additional one-year renewal options. Amendment No. 1 renewed the Agreement through April 14, 2018.  Now, the City and Dev-Land have mutually agreed to exercise the second renewal option.  Amendment No. 2 will renew the Agreement through April 14, 2019 in an annual amount not-to-exceed $210,000.

The Water Treatment Plant (WTP) generates a large amount of sludge during the process of improving the quality of water to make it more acceptable for end-use.  Under this contract, Dev-Land hauls this sludge from the City’s WTP to an approved site for proper disposal.

This motion is in accordance with the City Code of Ordinances, Section 36 and City Policies and Procedures, Change Orders and Amendments; Contracts must be amended in the same manner in which they were executed.
