Motion to approve and execute Amendment No. 01 to the  Grant Agreement No. 4600003488 with the South Florida Water Management District (SFWMD), for providing supplementary funding for the Area 12C Reclaimed Water System expansion project in the amount of $400,000, Project No. 2016-024, as part of their Cooperative Funding Program for Alternative Water Supply (AWS).

Background:

Since 2004, the City of Delray Beach (City) has maintained an annual program for expansion of its reclaimed water transmission system to provide an alternative irrigation source to City utility customers.  Under the AWS Program, SFWMD was able to provide supplemental funding for each of our expansion projects in previous years.  

 

In March 2016, the City was notified by the SFWMD that their AWS program was accepting applications for projects proposed for construction in fiscal year 2017/2018. In March 2016, the City utilized an approved engineering consultant, Mathews Consulting, retained through RFQ #2012-06 to perform the design, permitting and grant assistance for possible AWS funding. Through our consultant, on May 20, 2016, the City submitted its application to request funding assistance for the Area 12C Reclaimed Water system expansion; which the City Commission ratified at the June 21, 2016 City Commission meeting.  Area 12C encompasses the area on the barrier island south of Atlantic Ave, from Lewis Cove to Del-Haven Drive, and the area along A1A from Casuarina Road south to Hibiscus Road.  The project updates the pipe diameters and quantities from the original estimated preliminary designs to the actual quantities for construction.  The requested change does not alter the final grant award. 

 

At their September 8, 2016 meeting, the SFWMD Board approved their list of grant recipients which included the City of Delray Beach for the Area 12C Reclaimed Water Project in the amount of $400,000.  The Grant Agreement was approved by City Commission on November 15, 2016.  The final design for the project was completed by the engineering design consultant, Mathews Consulting in July 2017.  The Invitation To Bid for Construction (ITBC) for the project was advertised September 20, 2017.  On November 1, 2017 six (6) responses to the ITBC were received and the lowest responsible and responsible bidder, Lanzo Construction Co. was selected.  On January 2, 2018 City Commission approved the construction agreement with Lanzo Construction Co.

 

Based upon the final design and bid pipe diameters and quantities, which varied from the original estimated quantities prepared prior to design for the grant application, SFWMD requested we modify the original agreement to reflect final actual values. The City prepared modifications to Exhibit “A1” Statement of Work and Exhibit “B1” Summary Schedule of Tasks and Deliverables to reflect actual pipe diameters and quantities to be installed in this project. These modifications were reviewed, approved and incorporated by SFWMD into this Amendment to the grant agreement. 

 

City Attorney Review:

Approved as to form and legal sufficiency.

 

Funding Source/Financial Impact:

This is a grant agreement with SFWMD to assist with funding the reclaimed water main construction of the Reclaimed 12C project.  Grant funds have been approved by SFWMD in the amount of $400,000.

 

Timing of Request:

This request is time-sensitive as the SFWMD requires this executed amendment prior to releasing  grant funding.
