Motion to Approve and accept a 15’ Right of Way Deed at 455 NW 9TH ST.

Background:

Consider acceptance of a right of way deed for 15’ of dedication at 455 NW 9th St.

 

On October 2017, the owners (John and Adina Siedem) submitted Building Permit #17-172125 to construct a new single family residence located at 455 NW 9th St. This property is located west of N. Swinton Ave. on NW 9th St. on the north side of the roadway.

 

The roadway, NW 9th St. is a local street without curb and gutter which has an ultimate right of way width of 60-feet. In accordance with LDR 5.3.1(D), the existing right of way width is 12.5 feet on NW 9th St., per the survey, 17.5 feet would be required from this property. In January 2018, the City Engineer determined that a 15’ right of way dedication is acceptable as per the neighboring property to the east (per survey).
