Motion to approve Resolution No. 37-18 to award an Agreement to Siemens Industry, Inc. utilizing the existing contract prices provided to The National Joint Powers Alliance (NJPA), solicitation number 030817-SIE, in an amount not-to-exceed $75,000 annually for HVAC Systems Installation and Service with Related Products and Supplies.

Background:
On May 16, 2017, the City of Delray Beach (City) entered into an agreement with Siemens Industry Inc. in pursuant to solicitation No.RFP-12C-068/ City of Coral Springs for HVAC Preventative Maintenance and Unit Replacement Services; that agreement expires June 30, 2018.
On May 8, 2017 the NJPA awarded a contract to Siemens Industry, Inc. for HVAC Systems Installation and Service with Related Products and Supplies. The NJPA Siemens contract is valid from May 8, 2017 through May 8, 2021 with the option to renew for an additional 1-year term. The City of Delray Beach (City) is a long standing member of the NJPA; Member ID 7360.
The HVAC system at the Police Department includes specialized equipment that requires technical skills that other companies do not provide. Previously budgeted for $17,500, based on the best available information at this time, cost projections for the remainder of this fiscal year are estimated to be approximately $57,500.The Public Works Building Maintenance Division is requesting the City of Delray Beach enter into an agreement with Siemens Industry, Inc. to provide these types of services in a not-to-exceed amount of $75,000 per year until May 8, 2021, based on the pricing set per solicitation number 030817-SIE procured by the NJPA.
This motion is in accordance with City Ordinance and Purchasing Policy; Limited or No Competition Acquisitions and that use of the formal bid method is not in the best interest of the City.
City Attorney Review:
Approved as to form and legal sufficiency.
Funding Source/Financial Impact:
Funding is available from account number 001-41-350-519.34-90 (General Fund- Building Maintenance) as well as other various operating and capital accounts in the approved and applicable fiscal year budget.
Timing of Request:
It is imperative that the City take this action to prevent any interruptions of service to City facilities.
