Motion to approve Resolution No. 42-18 to award an Agreement with Baxter & Woodman, Inc. dba Mathews Consulting, a Baxter & Woodman Company for construction, engineering, and inspection services for the Phase 2 Seacrest Beautification project in an agreement value not-to-exceed $225,000.

Background:
On November 30, 2017, the City of Delray Beach (City) advertised Request for Qualifications No. 2018-003 for construction, engineering, and inspection (CEI) services for the Phase 2 Seacrest Beautification project. Four proposals were received and evaluated by an Evaluation Committee based upon the criteria in the solicitation. Baxter & Woodman, Inc. dba Mathews Consulting, a Baxter & Woodman Company (Mathews Consulting) was the highest ranked firm at the conclusion of evaluations. The final ranking of firms is as follows:

The project cost submitted by Mathews Consulting is a total amount of $199,870.00. Staff has reviewed the project cost and found it to be competitive and under the City’s budget for this project, which is $200,000. A City-controlled contingency of $25,130 is requested to account for potential issues associated with the bike path material. Any changes the City may have to adhere to due to the outcome of the Office of Inspector General’s Investigation of the Phase 0 bike path material may subsequently require more labor hours from Mathews Consulting, as they will be overseeing the construction administration and inspection services for this project. Therefore, staff requests approval of an agreement value not-to-exceed $225,000. The Agreement term will be from the date of full execution through the completion of work and full acceptance by the City, unless terminated earlier in accordance with terms set forth in the solicitation.
The City and Delray Beach Community Redevelopment Agency (CRA) have acknowledged the need for beautification and other necessary improvements through the development of the Seacrest/Del-Ida Park Neighborhood Plan, which was adopted by the City Commission on March 3, 1998. The City’s Bicycle/Pedestrian Plan as well as the Metropolitan Planning Organization Master Comprehensive Bicycle Transportation Plan also recommends the provision for bicycle facilities along the NE 2nd Avenue (Seacrest) corridor. As a result, the Seacrest Beautification projects will provide for and/or increase the use of pedestrian and bicycle facilities, while creating an appropriately improved streetscape within a highly visible neighborhood. This Agreement outsources the services to oversee the construction administration and inspection for the Phase 2 Seacrest Beautification construction. Phase 2 spans from NE 13th Street to NE 22nd Street along NE 2nd Avenue (Seacrest Blvd.).
This motion is in accordance with Code of Ordinances Section 36.02 Commission Approval Required.

Finance Department Review/Funding Source:
Funding is available from 377-41-340-541.68-18 - Capital Outlay NE 2 Ave/Seacrest Beautific Improvement. Failure to approve this contract could result in the loss of Florida Department of Transportation (FDOT) funding for this project.
Time Sensivity:
Approving this contract is time sensitive in order to meet production deadlines set by FDOT.
