Motion to Award an Amendment No. 1 to Agreement to Keith and Schnars, P.A. for construction, engineering, and inspection (CEI) services for Phase 1 of the NE 2nd Avenue / Seacrest Beautification in a total not-to-exceed amount of $93,597 for the Agreement Term (Project No. 14-071).

Background:
The Seacrest (NE 2nd Avenue) Beautification project was initiated in response to the requests from the Del Ida Park Neighborhood Community for a more aesthetically pleasing streetscape that addressed pedestrian and bicyclist safety along a main corridor leading directly into downtown Delray Beach. The City of Delray Beach and Delray Beach Community Redevelopment Agency (CRA) have acknowledged the need for beautification and other necessary improvements through the development of the Seacrest/Del-Ida Park Neighborhood Plan which was adopted by the City Commission on March 3, 1998. The Seacrest Beautification projects are federally funded through the Florida Department of Transportation (FDOT) Local Agency Program. The project evolved into four phases. Phase 0 limits are from Lake Ida to NE 8th Street / George Bush Boulevard and construction was completed December 2016. Phase 1 limits are from NE 8th Street/George Bush Boulevard (southern terminus) to NE 13th Street (northern terminus).
On June 20, 2017 the City of Delray Beach (CITY) Commission approved the award of an Agreement to Keith and Schnars, P.A. (K&S) for CEI professional services for Phase 1 of the Seacrest Beautification Project in a not-to-exceed amount of $181,000.
Due to weather, construction work change orders, and other delays outside K&S realm of authority, an additional 90 days are requested to complete the construction project listed above. The additional ninety days includes: 1) thirty days of regular construction time, 2) thirty days for the Substantial Completion walk through and punch list, and 3) thirty days for the final project closeout with the FDOT. The original date for Final Completion was May 29, 2018. The revised date for Final Completion is August 31, 2018.
K&S is requesting additional funds in a not-to-exceed amount of $93,597 based on the following criteria:
K&S based their original CEI Scope of Services on a eight month contract time frame (one month pre-construction / six month construction / one month closeout). K&S is requesting an additional ninety days (12 weeks) for the CEI services with includes the following breakdown of hourly rates/staffing (49 hour/work week):
CEI Inspector - 596.18 hours / $95 per hour = $56,637
CEI Contract Support Specialist - 264 hours / $135 per hour = $35,640
CEI Sr. Project Engineer - 8 hours / $165 per hour = $1,320
The City of Delray Beach is obligated to employ the professional services an independent consultant to provide CEI services throughout the term of the construction contract as part of the FDOT LAP agreement. K&S was selected through the RFQ process to perform CEI Professional Services for the NE 2nd Ave. / Seacrest Beautification Project Phase 1. Therefore, Amendment No. 1 to the Agreement with Keith & Schnars is presented to City Commission for a total not-to-exceed amount of $93,597 for the amended Term of the Agreement (ninety days).
This recommendation complies with the City Code of Ordinances, 21-17; Section 36.02.
City Attorney Review:
Approved as to form and legal sufficiency.
Funding Source/Financial Impact:
Funding in the amount of $93,597 will be available in Account number 334-41-340-541.68-18 (General Construction Fund: Other Improvements / NE 2 Ave/Seacrest Beaut.) after a budget transfer from Account No. 377-90-900-519.99-01 (One Cent Surtax) is approved.
