Motion to approve the Amendment to the Restrictive Covenant Agreement Between the City of Delray Beach and Lennar Homes

Background:
In 2006, City entered into an agreement with Lennar homes granting Lennar additional density for a project known as Village at Swinton Square in exchange for Lennar providing 24 workforce housing units. During course of construction, the address numbers for the workforce housing units were changed, even though the physical units remained the same. As a result, the City is amending the restrictive covenant to update Exhibit B “Restricted Units” to update the address numbers for the workforce housing units. Staff has confirmed that Swinton Square is in compliance with the City’s workforce housing requirements.
