Motion to approve a Consent to Assignment and Assumption Agreement from 169 NE 2nd d/b/a/ Max's Harvest to Integral Hospitality Group Holdings, LLC.

 

Body

Background:

On October 1, 2014, the City of Delray Beach (City) executed an agreement with 169 NE 2nd LLC d/b/a/ Max's Harvest for a Parking License Agreement. The Agreement allows operation of a valet parking stand.

 

The Max's Harvest property has been acquired by Integral Hospitality Group Holdings, LLC, has expressed its intention to assume all of 169 NE 2nd d/b/a/ Max's Harvest's rights and obligations with the City.

 

This recommendation is in accordance with the City Code of Ordinances.

A legal review checklist is attached.

 

Funding Source/Financial Impact:

This approval is required in order for the valet stand agreement to remain in effect. Failure to consent to the assignment of this agreement will result in lost annual revenue to the City of $5,940.

 

Timing of Request:

This request is time sensitive as this license agreement is being presented for a year extension and increase in fees this evening. This motion to approve must be granted in order to approve the extension of the license agreement.
