Motion to approve and accept a 5 foot wide sidewalk easement on 701 SW 2nd Court; legally described as Lot 9 and Lot 10, plat of Carver Square, according to the map or plat thereof, as recorded in Plat Book 24, Page 11 of Palm Beach County, Florida.

Background:
On February 20, 2018, the owner of the property, Delray Beach Housing Authority, submitted a Class II Site Plan Modification associated with a new roof, new doors and windows, new sidewalks, new ramps, new landscaping, new masonry wall, new gazebo. This project is still in review process.
It was discovered per survey that the sidewalk is on the private property, thus the 5 foot wide sidewalk easement is requested by the City Engineer.
City Attorney Review:
Approved as to form and legal sufficiency.
Funding Source/Financial Impact:
This item has no financial impact to the City.
Timing of Request:
The request is required to certify the plans and issue a building permit.
