Motion to Approve an Amendment to the Lease Agreement between the Arts Garage and the City of Delray Beach to allow the selling of liquor on performance nights on site at 94 NE 2nd Ave, Delray Beach, FL 33444.

 

Body

Background:

The Arts Garage entered into an lease agreement with the City of Delray Beach (City) on  December 8, 2016 for use of 94 NE 2nd Avenue which is located at the Old School Square Garage Building.  They proposed to use the location for visual artists, musicians, performers, film presenters, theater productions and workshops, arts education, community and cultural programs, cultural activities, musical performances, arts exhibitions, arts and music classrooms, and a small tenant administrative office.  Since the Arts Garage has been operating, they realized that they are missing an opportunity to raise funds by selling liquor on performance nights.  Old School Square presently is permitted to provide this service.  Please see attached letter from Arts Garage outlining their request.  To be able to sell the liquor, the City Attorney has determined that a lease agreement amendment is necessary and must be approved by the City Commission.
