Motion to approve Resolution No. 151-18 to award an agreement to DP Development of the Treasure Coast, LLC to perform stormwater infrastructure construction utilizing the City of West Palm Beach contract ITB Solicitation No. 13-14-407 in a not-to-exceed amount of $300,000.

Background:
The City of Delray Beach (City) maintains the City’s stormwater management system which includes pumps, pipes, stormwater inlets, exfiltration trench swales, check-valves to prevent tidal back-flow, wet and dry retention areas, canals and lakes. The Public Works Department maintains this system which contains hundreds of miles of pipes and 2,000 inlets. These structures were installed 30 or 40 years ago and have reached their useful life. Much of the stormwater infrastructure needs to be replaced or repaired. The Public Works Department does not have the man power or expertise to perform the construction activities necessary to restore, repair or enhance the system.
The City of West Palm Beach Commission awarded contracts to DP Development of the Treasure Coast, LLC, Hinterland Group LLC, DS Eakins Construction Corp., Foster Marine, and Murray Logan Construction Inc., for Continuing Services pursuant to its solicitation number ITB 13-14-407. Due to the urgent need for stormwater construction, the City wishes to move forward with an award to DP Development at this time, with the intention of awarding contracts to the remaining four firms. The scope of work within the West Palm Beach solicitation and agreement aligns with the scope of the construction needs that Delray Beach seeks to perform. The City desires to utilize the continuing services contract at the pricing provided to the City of West Palm Beach. This piggyback agreement will allow the City of Delray Beach to optimize resources, staff time and money in the performance of restoring stormwater infrastructure.

Approved as to form and legal sufficiency.
Funding Source/Financial Impact:
This construction contract will fund contractors to provide repair and replacement of the City’s stormwater facilities and infrastructure, providing a higher level of service of flood protection for the City.
Funding is available from account number #448-38-300-538.63-13
