Background:

The City and Verizon Wireless currently have a ground Lease Agreement for a portion of the City’s Police Tower located at 300 W. Atlantic Avenue.  The City was contacted by Verizon Wireless regarding its need to gain access to the tower in order to make modifications and upgrades to its equipment.  While the original agreement does provide for access, based on current issues with overloading of the tower as well as security concerns, this Agreement was necessary in order to outline the terms of Verizon’s access the City’s property.  This Agreement would require prior approval by the City regarding individuals who would be performing the work on the tower as well as requiring background checks of same.  This Agreement also requires a structural analysis for certain types of upgrades in order to alleviate the City’s concerns with overloading its tower.  The term of this Agreement is coterminous with the underlying ground lease as may extended or renewed.
