Motion to approve Resolution No.128-18 approving a Highway Maintenance Memorandum of  Agreement (HMMOA) with the State of Florida Department of Transportation (FDOT) for construction of improvements on Swinton Avenue from S 10 Street to N 4 Street , FDOT Financial Project ID  No. 438389-1

Background:

In 2014, the City applied for and received a grant from the Palm Beach County Transportation Planning Agency (TPA) to provide for improved bicycle lanes, pedestrian detectors and drainage on Swinton Avenue from SE 10th Street to N 4th Street.  The design and construction management of the proposed improvements for the Swinton Avenue project are being performed by the FDOT.  The  project is in the final design phase by FDOT, and includes milling and resurfacing the existing pavement to provide shared-lane markings (sharrows) along the segment, lowering the speed limit to 25 mph, upgrading signing and pavement markings, adding drainage improvements including exfiltration trenches, swales and impacted drainage inlets, and adding sidewalk from S. 10th Street to S 2nd Street. The project limits are on Swinton Avenue from S. 10 Street to N. 4  Street. 

 

The scope of this project originally included providing a bicycle facility to enhance north/south connectivity and the construction of missing sidewalk sections along the west side of Swinton Avenue from SE/SW 10th Street to NE/NW 4th Street.  The addition of two 5-foot dedicated bicycle lanes adjacent to the vehicular travel lanes was the original line of thought, however upon completion of the survey and initial design it became apparent that there were Right-Of-Way (ROW) limitations and any dedicated bicycle lanes would have significant impacts to other components of the corridors.  A Public Outreach event held at the City Library on November 27, 2018 to present the 30% design indicated that the public had significant concerns with the roadway widening impacts to other elements within the ROW (trees, landscaping, mailboxes, etc.).  Several alternatives were presented to commission during a workshop on January 22, 2019 where the City project management staff, FDOT and the TPA were presenting the information related to the project and potential project alternatives that could still meet the grant requirements for funding.  The Commission provided direction to proceed with the project with milling and resurfacing with sharrows (shared lane markings within the existing vehicular travel lanes) with no roadway widening to minimize the ROW conflicts.  The City issued a letter from the City Manager on January 29, 2019 at FDOT's request officially advising the FDOT of the City's wishes to proceed with milling and resurfacing with sharrows and sidewalks to retain the Mobility component of the project.

 

The project currently consists:

                     Milling & resurfacing with sharrow lane markings from SE 10th Street to N 4th Street

                     Adding sidewalk to improve connectivity from SE 10th Street to S 3rd Street

 

This FDOT project will provide resurfacing and minimal improvements between N. 2nd Avenue and S 2nd Avenue, as the City has a separate project to improve at the intersection of Swinton Avenue and Atlantic Avenue between N. 2nd Avenue and S. 2nd Avenue. The Swinton and Atlantic intersection project is budgeted in the City's FY 18/19 Capital Improvement Program.

 

The attached Highway Maintenance Memorandum of Agreement between the FDOT and the City will allow the FDOT to have their contractor perform the construction of the above-mentioned improvements. Approval of this HMOA allows the FDOT to move forward with the preferred design in a manner that meets with the production deadlines to complete the project on schedule. This project is planned to complete design in 2019 and to begin construction in 2020.

 

City Attorney Review:

City Attorney approves as to legal form and sufficiency.

 

Funding Source/Financial Impact:

This project is a Palm Beach County Transporation Planning Agency (TPA) funded project; the Federal Contribution for design and construction is estimated at $3,196,982.  The City has budgeted $200,000 for potential non-participating items, such as right of way maintenance, optional engineering work and MOT plans in account number 334-41-340-541.63-17 and City costs for FY 18/19 will not exceed this cost.
