Motion to approve and accept the pedestrian ingress and egress and vehicular easements for Midtown as a condition of approval of the alley abandonment approved by Resolution No. 10-18.

 

Body

Background:

On March 6, 2018, the City Commission approved an alley abandonment in Block 61, Town of Linton, associated with the Midtown Delray Development, located on the south side of Altantic Avenue between Swinton Avenue and SW 1st Avenue. The approval of the abandonment was conditioned on the acceptance and recording of a pedestrian and vehicular easement over the area of the alley right-of-way.

 

City Attorney Review:

Approved as to form and legal sufficiency.

Timing of Request:

The easements must be accepted by the City Commission and recorded prior to site plan certification and recorded concurrent with the recording of the alley abandonment.
