Motion to approve the Agreement of Use of Little Fenway at Miller Park with the South Florida Collegiate Baseball League per the terms and conditions set forth in the attached agreement.

Background:

On April 24, 2015, the City of Delray Beach City Commission approved a Use Agreement for Little Fenway at Miller Park with the South Florida Collegiate Baseball League - Delray Lighting. The term of this contract was for three (3) years (May 31, 2015 - August 1, 2018). The South Florida Collegiate Baseball League has satisfactorily satisfied all the terms of this agreement and it is the desire of the City of Delray Beach Parks and Recreation Department to enter into a new agreement with the South Florida Collegiate Baseball League for a term of three (3) years, with two (2) one-year renewals upon the written consent of both parties (2019 - 2023). If approved, the League would have first priority in scheduling games at Little Fenway at Miller Park between the dates of June 1st and August 1st of each year of this agreement.

 

If this Use Agreement is approved, the South Florida Collegiate Baseball League will, at its own expense, purchase a windscreen for Odom Field at Pompey Park in 2019, condition the infield of Little Fenway at Miller Park twice per year, purchase a new windscreen for Little Fenway at Miller Park prior to the 2022 season, be solely responsible for all field preparations and maintenance related to its use of Little Fenway at Miller Park, and shall continue to support both Little Leagues and Miracle League by taking such action as donations, paying to attend events, hosting free clinics and special events, and volunteering as umpires.

 

City Attorney Review:

Approved as to form and legal sufficiency.

 

Funding Source/Financial Impact:

This Use of Agreement would generate ($1.00) one-dollar each year for the length of the contract, as noted in the attached agreement (ATTACHMENT 3).

 

Timing of Request:

This is time sensitive as their 2019 season would begin in June 2019.
