Body

Recommended Action:

Recommendation

Review and consider the termination of the 12-foot drainage easement.

Body

Background:

The approved site plan for the Metropolitan at Delray, located at 101 SE 4th Avenue, was superseded by an approved site plan for Delray City Market. The Delray City Market project does not require a drainage easement.  The applicant is requesting approval of the termination of the 12-foot drainage easement as the approved site plan for Delray City Market does not require a replat, and the proposed building is to be constructed in the area of the 12-foot drainage easement.

City Attorney Review:

Approved to legal form and sufficiency.

Funding Source/Financial Impact:

N/A

Timing of Request:

A building permit shall not be issued until the drainage easement is terminated.
