Title

ACCEPTANCE OF A HOLD HARMLESS AGREEMENT TO RECONSTRUCT NEW EXTENDED FINGER PIERS, A SEAWALL AND A DOCK INTO AND OVER THE YACHT BASIN IN THE INTRACOASTAL WATERWAY WHICH IS OWNED BY THE CITY OF DELRAY BEACH.

Body

Recommended Action:

Recommendation

Review and consider the Hold Harmless Agreement of the submerged lands within the yacht basin to improve and reconstruct new extended finger piers, a seawall and dock.

Body

Background:

The improvements are in a Yacht Basin adjacent to the Intracoastal Waterway on the eastside between Casuarina Rd and Nassau Street that is owned by the City of Delray Beach therefore requiring the hold harmless agreement. If the hold harmless agreement is accepted, a variance and building applications will need to be submitted and approved for the new docks.

At its meeting of October 10, 2018, The Site Plan Review and Appearance Board approved (7-0) a Class V Site Plan, Landscape Plan and Architectural Elevations for the construction of one building that incorporates four identical condominiums that consists of 2,533 SF.  The units are two stories with roof top terraces accessed via the stair/elevator entrance, common pool.   The property has access to the Intracoastal Waterway; docks were not included or part of the Class V approval.  The proposed Exhibit A demonstrates that the applicant is constructing a new 3 foot seawall, a 5 foot wood dock and reparing two finger piers at 5 feet by 45 feet.
