Approve the Memorandum of Understanding between the Delray Beach CRA and the Palm Beach County Commission on Ethics.

Background:
As a dependent district, the Delray Beach CRA is not under the jurisdiction of the Commission on Ethics by statute or referendum. At the CRA’s request, Mr. Alan Johnson, Executive Director of the Palm Beach County Commission on Ethics, made a presentation to the board regarding the adopted Code of Ethics at the CRA Board workshop meeting on October 27, 2011. On October 11, 2012, the CRA received a letter from Mayor McDuffie requesting that the CRA agree to enter into an a Memorandum of Understanding (MOU) with the Palm Beach County Commission on Ethics in order to be more formally bound by Palm Beach County’s ethic rules. On November 15, 2012 this item was passed by the CRA Board. The original MOU was entered into in January, 2013 then again in 2016, which expired in January, 2019.
Attached is the (MOU) between the Delray Beach CRA and Palm Beach County Commission on Ethics for the Board’s consideration. The term of the agreement is proposed to be retroactive to start on January 13, 2019 and remain in effect through September 22, 2022.
The MOU authorizes the Commission on Ethics to exercise authority, functions and powers granted by the Commission on Ethics ordinance over the operations of the CRA. This includes oversight, training and advisory functions of the Commission on Ethics to the CRA Board and staff. The MOU includes a provision of fees to be paid to the Commission on Ethics in exchange for its services, based on the fee schedule included in the MOU (Section IV).
