Approve Resolution No. 192-19 committing the City of Delray Beach to enter into an Interlocal Agreement (ILA) formalizing the Coastal Resilience Partnership (CRP) and becoming party to the Work Plan Agreement for the Community Climate Vulnerability Assessment (CCVA), which commits the city to a $57,399 as the proportional share of the overall $375,000 project cost.

Background:

The Palm Beach County CRP began in 2017 as the ‘Inlet to Inlet’ group when neighboring municipalities met to discuss adaptive measures to withstand extreme weather events and prepare for future effects of sea level rise and climate change. CRP seeks to procure a Community Climate Vulnerability Assessment (CCVA) and acknowledges that a collaborative regional approach would be cost effective and would advocate a more coordinated implementation of policies across jurisdictional boundaries.

The City of Boynton Beach led the initial planning phase of the collaboration with a FY 18/19 Resilience Planning Grant of $72,000 from the Florida Department of Environmental Protection (FDEP)/Florida Resilient Coastlines Program. Boynton Beach contracted Corollo Engineering to develop a methodology and work scope for the CCVA and assess the status and availability of needed data to issue an RFP for the CCVA. The partnership was awarded a second (FY 19/20) Resilience Planning Grant of $75,000; however, Boynton Beach is unable to formally accept the Phase II grant money from the State until all the participating municipalities agree to an Interlocal Agreement (ILA) and associated financial obligations.

The ILA is an agreement among City of Boca Raton, City of Boynton Beach, City of Delray Beach, Town of Highland Beach, City of Lake Worth Beach, Town of Lantana, the Town of Ocean Ridge, and Palm Beach County (hereafter known as “Participants”). With assistance from Harvard Law School’s Emmett Environmental Law & Policy Clinic, the ILA was drafted by Boca Raton’s City Attorney with assistance from attorneys for Lake Worth Beach, Ocean Ridge, and Highland Beach.

 

The CCVA will explore climate threats, identify and evaluate community assets, assess vulnerabilities and risks, investigate potential adaptation strategies and provide a GIS-based interactive mapping tool for the use of Participants. Tasks 1 and 2, exploration of climate threats and identification and evaluation of community assets, will be paid for by the FDEP FY 19/20 Resilience Planning Grant. Tasks 3-4 dealing with assessment of vulnerabilities and potential adaptation strategies, will be funded by budgeted contributions from each of the eight Participants as detailed in the Interlocal Agreement:

 

The City of Lake Worth Beach has agreed to serve as the procurement and fiscal agent for the CCVA project; and will collect, manage, and make payment to the selected consultant in accordance with the agreement.

 

The City of Boynton Beach will serve as the recipient and manager of the FY 19/20 FDEP Resilience Planning Grant of $75,000; and will collect grant payments and distribute them to City of Lake Worth Beach in a method agreed upon by the two cities’ finance departments.

Funding Source/Financial Impact:

The City of Delray Beach will be responsible for $57,399 of the total $366,797 cost for the CCVA, funds for this have been budgeted in the Sustainability/Resilience budget in the City Manager's Office, account number 001-12-070-513.31-90.

This matter is time sensitive in order to meet FDEP grant deadlines.
