Motion to Approve Resolution 216-19 approving Amendment No. 4 to the Agreement between the City of Delray Beach and Players International Management, Inc., finding that approval of said Amendment is in the best interests of the City and that waiver of competitive requirements is appropriate.

 

Body

Background:

On March 6, 2008, the City entered into an Agreement with Players International Management, Inc. (“PIM”) for its non-exclusive right to use the City of Delray Beach’s tennis facilities for tennis events (“Agreement”).  The original Agreement between the City and PIM has been previously amended 3 times.

 

In 2016, a dispute arose between the City and Match Point concerning the validity of the Agreement which resulted in the City filing an action for declaratory relief (Palm Beach County Case No. 502016CA002812).  Settlement of that matter is conditioned on approval of this Amendment. 

 

This Amendment No. 4 modifies the original agreement between the City and PIM by extending the agreement through September 30, 2025.  There are no other changes to the Agreement.
