Motion to Approve Resolution No. 43-20 in support of Florida Power and Light (FPL) for the installation of Decorative LED Street Lights for the Osceola Park Neighborhood Improvements Project and for the payment of a not-to-exceed amount of $300,000 for the design and installation of the Decorative LED fixtures.

Background:
The City of Delray Beach (City) has a Neighborhood Improvements Project at Osceola Park Neighborhood. This project includes improvements to the infrastructure and safety of the neighborhood, including water, sewer, drainage, sidewalks and street lighting. The street lighting component will enhance public safety and electrical efficiency by replacing the existing cobra-head fixtures with LED fixtures (LED versus the conventional Halogen fixtures). This project is being funded through the Delray Beach Community Redevelopment Agency (CRA).
The decorative street lighting work is designed and installed by Florida Power and Light (FPL). FPL requires that the City pay a not-to-exceed amount of $300,000 prior to commencing any design work. This fee will be applied to the Cost in Aid of Construction (CIAC) that the lighting designer will calculate during the engineering review after FPL's design commences. CIAC covers the remaining book value and cost of removing existing lights and poles as called for by the plans, as well as any non-standard installation costs such as directional boring or transformers that may be required by the final design.
City Attorney Review:
City Attorney recommends approval as to form and legal sufficiency.
Funding Source/Financial Impact:
Funding in an amount not to exceed $300,000 is contingent upon passage of an Interlocal Agreement (ILA) for Construction/Professional Services by the Delray Beach CRA Board of Director and by the Delray Beach Commission and will be available from account number 334-41-340-541. 63-20, Capital Outlay-Improvements upon passage of the ILA.
Timing of Request:
The approval of this item is highly time sensitive as the project will be commencing construction in the next several months and it is desired that FPL will coordinate and complete the work in the same timeframe.
