DISCUSSION AND DIRECTION CONCERNING REQUEST FOR INDEPENDENT LEGAL REPRESENTATION

Body

Recommended Action:

Recommendation

The City Attorney seeks direction regarding a request from George Gretsas seeking independent legal representation at the expense of the City.

Body

Background:

On July 1, 2020, City Manager George Gretsas sent a request to Mayor Shelly Petrolia seeking independent legal representation from the City in connection with the proceedings related to the City’s investigation of Complaints filed by Suzanne Fisher and Sam Metott.

Pursuant to his Agreement with the City, “[e]mployee may request, and the City shall not unreasonably refuse to provide, independent legal representation at the City’s expense if there is a conflict of interest between Employee’s interests and the City’s interests.  Legal representation provided by the City for Employee shall extend until a final determination of the legal action, including any appeals brought by either party.  This paragraph shall not apply to litigation between the parties to this Agreement concerning an alleged breach of the Agreement.”

City Attorney Review:

The City Attorney seeks direction from the Commission on this matter.
