Approve the proposed amendments to Delray Beach Community Redevelopment Agency By-laws or provide input on the proposed amendments.

Background:

The Delray Beach Community Redevelopment Agency Bylaws was last amended in September 10, 2019.

 

Recently, we reviewed the Bylaws and propose the following change:

                     Remove Section 3.4 - Annual Meeting

o                     In past years, the appointments were made for Board Members to participate in certain advisory boards and these appointments were made at the “Annual Meeting”, however, several years ago the appointments were removed from the By-laws.  Therefore, this amendment removes the term “Annual Meeting”. 

                     Remove from Section 4.1 & 4.4 First Vice Chair position; Remove from Section 4.1 & 4.6 Treasurer position

o                     Staff is proposing to remove the Treasurer position as last year we changed the CRA Accounting Policy to allow for Staff to sign checks, which was one of the functions of the Treasurer. Therefore, we are now updating the Bylaws to reflect the changes made to the Accounting Policy. 

o                     Florida Statutes 163.356 states that governing body of the CRA (City) shall designate a Chair and Vice Chair from among the commissioners and the City designates these positions annually unless otherwise stated.  Therefore, we are proposing to remove the First Vice Chair position as the Chair and Vice Chair are designated annually.
