Item B1 - Motion to approve and accept a Right-of-Way Deed for 301 NE 8th Ave. to the City of Delray Beach.

Background:
Item A1 -- Florida Power and Light, as a part of their effort to underground power lines on NE 12th Street has requested that the City of Delray Beach dedicate a 10’ x 10’ Easement in favor of Florida Power and Light which intends to use it to install a transformer. This Utility Easement Dedication to Florida Power and Light is located at 223 NE 12Th St.
Item -B1 -- The owner(s), Azure 301 NE 8th Avenue LLC., submitted building permit # 19-00185171 on 8/20/19 to construct a new single-family residence. NE 3rd Street has been determined to have a right-of-way width of 50 feet and requires a 25-foot radius at the intersection between local streets. In accordance with LDR 5.3.1 (D) and 6.1.2(C) (2) (e), a 15-foot tangent dedication and 25-foot radius dedication is needed. Acceptance of a Right-of-Way Dedication located at 301 NE 8th Ave, will satisfy this requirement.
City Attorney Review:
Approved as to form and legal sufficiency.

There is no City cost now or in the future for these items.
