Motion to Approve Resolution No. 167-20 to approve an Interlocal Agreement (ILA) with Palm Beach County and the City of Delray Beach (City) for the design and construction of a traffic signal at the intersection of W. Linton Boulevard and Catherine Drive/Linton Lakes Drive. 

 

Body

At the City's request, Palm Beach County (County) is installing a traffic signal at the intersection of W. Linton Boulevard and Catherine Drive/Linton Lakes Drive to improve safety at the intersection.  The installation of the traffic signal cost is being cost shared 50% by Palm Beach County and 50% by the City.  As a condition to install the traffic signal, the County requested that the Catherine Drive approach be improved to include an outbound (southbound) left-turn lane and a wider inbound (northbound) receiving Lane.  The City has an executed agreement with a design engineer for these improvements and the design is ongoing.  The City is 100% financially responsible for the design and construction of the Catherine Drive approach improvements, estimated at $54,359 and $103,329 respectively for a total of $157,688.

 

This project has two components, (1) the improvements to Catherine Drive that the City is responsible for designing and constructing and (2) the installation of the traffic signal on W. Linton Boulevard that the County will be designing and installing.  The ILA referenced herein is for the County's portion of the project, the design and construction of the traffic signal. The ILA with the County has two cost elements:

 

                     1. The County and the City have agreed to share the costs for design and construction of the traffic signal. The project costs related with this agreement are for 50 percent of the total cost ($280,000) to design, construct, and inspect the project which equates to a City responsibility of $140,000. Additionally, if the total cost exceeds $280,000, the City is required to reimburse Palm Beach County for 50 percent of the total actual costs required to design, construct and inspect the Project.

 

 

                     2. The City is required to reimburse Palm Beach County for 100 percent of the total costs incurred to acquire any easements determined necessary by Palm Beach County for the Project. This includes any easements needed to maintain the project  (traffic signal) in perpetuity once it is built. The costs to acquire the easements needed for the project shall be based on the actual costs incurred by Palm Beach County as documented by the Palm Beach County Engineering and Public Works Department. Costs for the easement(s) are not anticipated to exceed $200,000.

 

The total anticipated cost the City will have to pay the County is $340,000 for the project at this time; which includes $140,000 for the Traffic Light and $200,000 for the easements.

 

Background:

This project includes improvements to the intersection to improve the safety of the neighborhood, and includes a traffic light, a right-turn lane a left-turn lane, and associated signing and pavement markings. The traffic light component will enhance public safety.

 

City Attorney Review:

Approved as to form and legal sufficiency.

 

Funding Source/Financial Impact:

Funding in the amount of $450,0000 was approved in the Capital Budget for FY 2021 and is available from account number 377-41-340-541-68.01.

 

Timing of Request:

The approval of this item is highly time sensitive as the project needs to commence with acquisition of the easements so that this work may proceed to improve the safety at the intersection of W. Linton Boulevard and Catherine Drive/Linton Lakes Drive.
