Recommended Action:
1) Approval of authorization to hire outside counsel for litigation, as needed;
2) Approval of authorization CRA Board Chair to execute all documents for said purpose; and
3) Approval of authorization of the disbursement of funds for said purpose.
Body
Background:
The legal services are necessary to provide litigation defense to the CRA in a pending lawsuit against the CRA. The CRA staff has made a very diligent effort to hire an experienced litigation law firm to provide specialized legal services in the pending lawsuit.
Consistent with section 163.356(3)(c), Florida Statutes states that “[f]or such legal services as it requires, an agency may employ or retain its own counsel and legal staff.”
At this time, before the CRA Board is a motion approving hiring outside counsel for litigation, as needed; further authorizing the CRA Board Chair to execute all documents for said purpose; and authorizing the disbursement of funds for said purpose.
