Background:
The Delray Beach Shore Protection Program consists of the design, permitting, construction and monitoring of approximately 2.6 miles of shoreline. The primary focus of the program is to provide for the protection and enhancement of the beach and coastal resources in accordance with State and Federal permit conditions. The City of Delray Beach holds a Joint Coastal Permit (JCP), Permit No.0303553-001-JC, with the Florida Department of Environmental Protection (FDEP) and the United States Army Corp of Engineers (USACE) for sand nourishment of the beachfront with offshore borrow areas. The JCP has conditions specific to the beach nourishment / construction activities, marine turtle and manatee protection, monitoring and reporting. The JCP requires annual post-construction physical beach monitoring studies for three-years following sand nourishment events. The City of Delray Beach has participated in nine beach nourishment projects from 1973 to 2020, with the most recent sand renourishment project completed in 2020 in response to damages incurred by the 2017 hurricane season. The City is currently in the planning stages for the next regular periodic renourishment event including permitting and construction documents development (engineering), post-construction monitoring for the 2020 (USACE storm repair renourishment) projects.
The Delray Beach Shore Protection Program includes annual topographic (onshore) and bathymetric (offshore) surveys of the beach and offshore. The monitoring data is used to asses, with quantitative measurement, the performance of the beach replenishment projects. The monitoring data provides the City and the Florida Department of Environmental Protection information necessary to plan for the next renourishment project, evaluate the beach performance and optimize the design of the next beach renourishment project.
On November 25, 2017, the City advertised a Request for Qualifications (Bid No.2015-01) for Coastal Engineering Consulting Services. On August 26, 2015, The City executed an agreement with CB&I Environmental & Infrastructure, Inc. to provide Coastal Engineering Consulting Services. The Agreement is for assistance with managing the Beach Renourishment Program, including funding applications, permit acquisition, consultant and construction contract supervision and professional advice and monitoring services regarding the coastline and its management. The Agreement term is for five years from August 26, 2015 through August 25, 2020 with an option to renew for an additional two three-year terms. On August 13, 2020 the City executed Amendment No.1 to extend the aforementioned contract period from August 26, 2020 to August 25, 2023.
On June 30, 2017 CB&I Environmental & Infrastructure, Inc. was acquired by Veritas Capital and has rebranded their business as Aptim Environmental & Infrastructure, Inc. (Aptim). Aptim has expressed its intention to assume all of CB&I Environmental & Infrastructure, Inc. rights and obligations of these awards under the terms and conditions set forth in the Agreement for consulting services with the City. The Consent to assignment from CB&I Environmental & Infrastructure, Inc. to Aptim was approved by City commission on March 6, 2018.
Under this service authorization, Aptim will provide coastal engineering consulting services including continuing post-construction monitoring for the 2020 storm nourishment project with the annual beach monitoring surveys and pre-construction subaquatic vegetation investigation and borrow area surveys for the 6th regular beach nourishment project planned for Winter 2021/2022 for the City of Delray Beach’s Nourishment Program. Total estimated cost for services under Service Authorization No. 7 is in the amount not to exceed $181,560.
Pursuant to Sections 161.091 - 161.161, Florida Statutes, the FDEP provides financial assistance to eligible governmental entities for beach erosion control and inlet management activities under the Florida Beach Management Funding Assistance Program. On January 19, 2021 the City commission approved a grant agreement 21PB2 with FDEP in the amount of $3,211,945 for their cost share reimbursement of the City’s Shore Protection Project including surveys of the beach and offshore and construction reimbursements for the next nourishment project planned for Winter 2021/2022 and post-construction monitoring activities from the 2020 storm nourishment project.
Allocation of Funding:
The continuing post-construction monitoring for the 2020 storm nourishment project with the annual beach monitoring surveys and pre-construction subaquatic vegetation investigation and borrow area survey services proposed in this Service Authorization were programmed on the Capital Improvement Program budget for Fiscal Year 20/21. The funds requested are partially reimbursement by the Federal and State government partners as shown in the table below (and based on availability of funding). Note that the State cost share for the services herein is $39,643.63 and are reimbursable fees in the grant agreement approved by City commission January 19, 2021. The Federal cost share / reimbursement is currently an ongoing discussion with administration at the USACE; however the cost share listed on the table is based on a long standing agreement between the City and USACE.
City Attorney Review:
City Attorney approves as to form and legal sufficiency.
Funding Source/Financial Impact:
This approval is required for the City to continue towards the 6th regular renourishment event planned for Winter 2021/2022, reporting for the beach nourishment program’s compliance with Federal, State and Local permits and funding assistance for beach renourishment and associated projects. Funding is available from account number 332-41-363-572.31-10 (Beach Restoration Fund-Professional Services/Engineering).
Timing of Request:
This request is time-sensitive as the services herein preserve the annually required permit reporting, maintain the schedule for the next beach restoration and continues to support the City’s Shore Protection Program.
